Poland probing OpenAI, ChatGPT following GDPR complaint


Poland's Personal Data Protection Office has opened an investigation into a complaint against OpenAI's ChatGPT, with an anonymous complainant accusing the company of processing data in an "illegal and unreliable manner."

In a statement on September 20, Jan Nowak, president of the data protection office saying This is not the first time that ChatGPT's compliance with European data protection and privacy principles has been questioned.

The complaint accuses OpenAI of processing data illegally and unreliably, and that the rules under which it collects and processes data are not transparent.

The applicant said that in his case ChatGPT generated false information about him and that OpenAI did not comply with his demands for the exercise of rights under the European General Data Protection Regulation (GDPR).

However, Nowak admitted that the proposed procedure against OpenAI could be difficult, since it involves a company located outside the European Union.

"The case concerns the violation of many provisions on the protection of personal data, so we will ask Open AI to answer a series of questions so that we can carry out in-depth administrative procedures," Nowak said.

Meanwhile, Jakub Groszkowski, vice president of the Polish office, said the allegations in the complaint raise questions about OpenAI's approach to European principles on personal data protection.

Therefore, the Office will clarify these doubts, particularly in the context of the fundamental principle of privacy by design contained in the GDPR, he added.

This is not the first time OpenAI has apparently run afoul of European GDPR compliance.

In March, Italian data protection authorities announced that they would temporarily block the artificial intelligence chatbot ChatGPT and open an investigation into suspected data privacy breaches rules.

The Italian data watchdog also said there is a lack of information for users about the data collected by OpenAI.

In April, regulators in Germany reportedly demanded answers about the company's intentions and ability to comply with the strict data privacy laws enshrined in the EU GDPR.

The same month, the European Data Protection Board created a special working group on OpenAI.
